AB 339 and SB 827:  Compliance Clarity for California Agencie

AB 339 is here – and local agencies need clear, workable guidance.  With an effective date of January 1, 2026, AB 339 creates a new advance notice requirement under the Meyers-Milias-Brown Act (MMBA) when a California local public agency is considering contracting out work that falls within the scope of represented bargaining-unit classifications.  Among other requirements, agencies must provide 45 days’ written notice to the recognized employee organization before the agency issues an RFP, issues an RFQ, or renews or extends an existing contract for services within the scope of represented job classifications

While most of the webinar will focus on AB 339, a brief overview of SB 827, which introduces new requirements for local government agencies in California regarding the training of local agency officials, will also be included.  SB 827 mandates that all local agency officials – including elected and appointed members of city councils, county boards of supervisors, and other governing bodies subject to the Ralph M. Brown Act or similar open meeting laws – undergo specified training.  Officials who commence service on or after January 1, 2026, must receive their initial training within 6 months of commencing service.  Every local agency official in a local agency’s service as of January 1, 2026, and who commenced that service prior to January 1, 2026, must receive this training before January 1, 2028.  Because training will likely be available from a variety of sources, CSMFO recently created a certification program to help agencies determine whether any such training complies with the requirements of SB 827.
