Title of Session or Presentation:

Update on Sheetz v. County of El Dorado

Description of Session:

Our speakers presented the following topic at our May 22, 2024, Orange County Chapter meeting, "Current Trends and Challenges with Development Impact Fees (DIFs): Judicial and Legislative Changes and Practical Implications on DIFs. "

This session will provide an update on the Sheetz v. County of El Dorado litigation and possible impacts to DIFs.

Speaker Bios:

Lutfi Kharuf is a partner in the Special Districts and Public Finance practice groups of Best Best & Krieger LLP. Lutfi works with public agencies on compliance with constitutional and statutory limitations on imposing fees, charges, and taxes, including the Mitigation Fee Act, Proposition 218, and Proposition 26. In this capacity, Lutfi assists public agencies with adopting new and increased fees, charges, assessments, and taxes, as well as forming Community Facilities Districts (CFDs) and Assessment Districts (ADs). Lutfi serves as chair of the Municipal Finance Committee of the California League of Cities, and sits on the Legal Affairs Committee for the Association of California Water Agencies.

Andrea Roess, a Managing Director at DTA, has participated in all aspects of the formation and implementation of special finance districts to fund infrastructure and services since joining the firm in 1992. She has developed sophisticated bond structuring concepts for CFDs and ADs and complex
fiscal impact and fee impact models, in addition to preparing numerous fee and rate studies for various public agencies, including cities, counties, and water districts. Andrea holds an M.B.A. degree with a concentration in finance from San Francisco State University and a B.A. in psychology/public policy analysis from Pomona College. She is also active in industry groups, including CSMFO and many others. Notably Andrea has been elected the Director of Mentorship of the Women in Public Finance Los Angeles Chapter Board, serves as the Treasurer of the Board of Directors for the Association of Women in Water, Energy, and Environment (AWWEE), and has participated on numerous panels and workshops related to public financing.
